1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of TrueShot, a photo verification service operated by Rial Labs, Inc. ("Company," "we," "us," or "our"). By accessing or using TrueShot, you agree to be bound by these Terms.

These Terms apply to:

• Claimants: Individuals who use TrueShot links to submit photos for insurance claims
• Insurance Adjusters: Professionals who use the TrueShot dashboard to request and review photos
• Insurance Companies: Organizations that contract with us to use TrueShot for claims processing

2. Description of Service

TrueShot is a secure photo submission and verification platform designed for insurance claims. The service includes:

• SMS-based photo request links sent to claimants
• Mobile-optimized photo capture interface
• Cryptographic verification of photo authenticity
• Secure photo storage and delivery to insurance companies
• Dashboard for insurance adjusters to manage requests

3. User Responsibilities

3.1 For Claimants

When submitting photos through TrueShot, you agree to:

• Submit Truthful Photos: Only submit genuine, unaltered photos that accurately represent the subject of your claim
• Own or Have Rights: Only submit photos you have taken or have permission to submit
• Accurate Information: Provide accurate information associated with your photos
• Timely Submission: Submit photos before the link expires (typically 7 days)
• Appropriate Content: Do not submit photos containing illegal, offensive, or inappropriate content

3.2 For Insurance Adjusters

When using the TrueShot dashboard, you agree to:

• Maintain confidentiality of claimant information
• Use the service only for legitimate insurance claim purposes
• Keep your login credentials secure
• Comply with your organization's policies and applicable laws
• Not share access with unauthorized individuals

4. Prohibited Conduct

You agree NOT to:

• Submit fraudulent, manipulated, or misleading photos
• Attempt to circumvent or interfere with the verification system
• Use the service for any illegal purpose
• Submit photos on behalf of someone else without authorization
• Attempt to access other users' data or accounts
• Reverse engineer, decompile, or disassemble any part of the service
• Use automated systems (bots, scrapers) to access the service
• Interfere with or disrupt the service's operation

5. Photo Verification

5.1 What We Verify

TrueShot's verification technology confirms:

• When a photo was captured (timestamp)
• Where a photo was captured (GPS location, if available)
• That the photo has not been digitally altered after capture
• The device used to capture the photo

5.2 What We Do NOT Verify

TrueShot does NOT verify:

• The truthfulness of what is depicted in the photo
• Whether a scene was staged before the photo was taken
• The identity of the person who took the photo
• The validity of the underlying insurance claim
• Whether damage occurred as described by the claimant

5.3 Verification Limitations

Verification accuracy depends on:

• Device capabilities and settings
• Whether location services are enabled
• Network connectivity during submission
• Proper use of the service as intended

6. Intellectual Property

6.1 Your Photos

You retain ownership of photos you submit. By submitting photos, you grant us and the relevant insurance company a license to:

• Store and process your photos for claim purposes
• Generate verification proofs from your photos
• Share photos with authorized insurance personnel
• Retain photos as required for record-keeping

6.2 Our Technology

All intellectual property in TrueShot, including software, algorithms, trademarks, and documentation, belongs to Rial Labs, Inc. These Terms do not grant you any rights to our intellectual property except as necessary to use the service.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using TrueShot, you consent to the practices described in the Privacy Policy.

8. SMS Communications

By receiving a TrueShot link via SMS:

• You acknowledge that your insurance company requested photos from you
• You consent to receive this service-related message
• Standard message and data rates from your carrier may apply
• This is not a marketing subscription; you will only receive messages related to specific photo requests

9. Link Expiration

Photo submission links expire after a set period (typically 7 days). Once expired:

• You will not be able to submit photos using that link
• Your insurance company may send a new request if needed
• Contact your insurance company if you need more time

10. Service Availability

• We strive for high availability but do not guarantee uninterrupted service
• We may perform maintenance that temporarily affects availability
• We are not responsible for issues caused by your device, network, or carrier
• We reserve the right to modify or discontinue the service with reasonable notice

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

TRUESHOT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF VERIFICATION RESULTS

We do not warrant that the service will be uninterrupted, error-free, or completely secure.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

RIAL LABS, INC. SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Decisions made by insurance companies based on submitted photos
• Claim denials or delays related to photo submissions
• Third-party claims related to your use of the service
• Damages exceeding $100 or the fees paid for the service (whichever is greater)

13. Indemnification

You agree to indemnify and hold harmless Rial Labs, Inc., its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of TrueShot
• Photos you submit through the service
• Your violation of these Terms
• Your violation of any rights of others
• Any fraudulent or illegal activity

14. Insurance Claim Decisions

Important: TrueShot is a photo submission and verification tool only. We do not:

• Make decisions about your insurance claim
• Determine claim eligibility or payout amounts
• Represent or act on behalf of any insurance company
• Provide insurance advice or services

All claim decisions are made by your insurance company. Contact them directly with questions about your claim.

16. Dispute Resolution

16.1 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

16.2 Arbitration

Any dispute arising from these Terms or your use of TrueShot shall be resolved through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules. The arbitration shall take place in Wilmington, Delaware, or remotely at your election.

16.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class actions or class arbitrations.

16.4 Exception for Small Claims

Either party may bring claims in small claims court if eligible.

17. Termination

We may suspend or terminate your access to TrueShot at any time for:

• Violation of these Terms
• Suspected fraudulent activity
• Abuse of the service
• At the request of the relevant insurance company
• Legal or regulatory requirements

18. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through:

• Notice on the TrueShot website
• Updated "Last Updated" date
• Email notification (for registered adjusters)

Continued use of TrueShot after changes constitutes acceptance of the modified Terms.

19. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rial Labs, Inc. regarding TrueShot.
